Part I: PreliminaryI хэсэг: Ерөнхий зүйл
9.1CITATION AND COMMENCEMENTНэрлэх ба хүчин төгөлдөр болох
9.1.1These Regulations may be cited as the ITTF Integrity Regulations and shall come into operation on 05 December 2022.Энэхүү Журмыг «ITTF-ийн Шударга байдлын журам» гэж нэрлэж болох бөгөөд 2022 оны 12-р сарын 05-наас эхлэн хүчин төгөлдөр мөрдөгдөнө.
9.2DEFINITIONSТодорхойлолт
9.2.1The capitalised terms used in these Regulations are as defined in the ITTF Statutes or as follows, unless the context otherwise requires:Энэхүү Журамд том үсгээр эхэлсэн нэр томьёог, агуулгаас өөрөөр шаардахгүй бол, ITTF-ийн Дүрэм журам (ITTF Statutes)-д тодорхойлсноор эсвэл дараах байдлаар ойлгоно:
9.2.1.1“AGM” means an annual general meeting of ITTF.«AGM» гэж ITTF-ийн Бүх гишүүдийн ээлжит хурал (AGM)-ыг хэлнэ.
9.2.1.2“Alleged Person” means the person or party who is suspected to have committed a violation of the Applicable Rules.«Зөрчил гаргасан гэж сэжиглэгдэж буй этгээд (Alleged Person)» гэж Хамаарах дүрмүүд (Applicable Rules)-ийг зөрчсөн гэж сэжиглэгдэж буй хүн эсвэл талыг хэлнэ.
9.2.1.3“Applicable Rules” has the meaning given to it in R9.4.2.«Хамаарах дүрмүүд (Applicable Rules)» гэдэг нь R9.4.2-т өгсөн утгыг агуулна.
9.2.1.4“Appropriate Person” has the meaning given to it in R9.24.1.«Зохих этгээд (Appropriate Person)» гэдэг нь R9.24.1-д өгсөн утгыг агуулна.
9.2.1.5“CAS” means the Court of Arbitration for Sport.«CAS» гэж Спортын арбитрын шүүх (Court of Arbitration for Sport)-ийг хэлнэ.
9.2.1.6“EGM” means an extraordinary general meeting of ITTF.«EGM» гэж ITTF-ийн ээлжит бус хурал (EGM)-ыг хэлнэ.
9.2.1.7“Independent Member” means a member of the Integrity Board that meets the Independence Requirements and has voting rights.«Хараат бус гишүүн (Independent Member)» гэж Хараат бус байдлын шаардлага (Independence Requirements)-ыг хангасан, санал өгөх эрхтэй Шударга байдлын зөвлөл (Integrity Board)-ийн гишүүнийг хэлнэ.
9.2.1.8“Independence Requirements” has the meaning given to it in R9.6.1.«Хараат бус байдлын шаардлага (Independence Requirements)» гэдэг нь R9.6.1-д өгсөн утгыг агуулна.
9.2.1.9“Investigation Notice” means a written demand to a Table Tennis Party for information relating to any potential breach of any Applicable Rule, as further described in R9.17.6.«Мөрдөн шалгалтын мэдэгдэл (Investigation Notice)» гэж аливаа Хамаарах дүрмийг зөрчсөн байж болзошгүй тохиолдолтой холбоотой мэдээлэл өгөхийг Ширээний теннисний тал (Table Tennis Party)-аас шаардсан бичгэн шаардлагыг хэлнэ. 9.2.1.10“ITTF Integrity Board” means the supervising body of the ITTF Integrity Unit, consisting of the ITTF Integrity Board Members.«ITTF-ийн Шударга байдлын зөвлөл (ITTF Integrity Board)» гэж ITTF-ийн Шударга байдлын алба (Integrity Unit)-ыг хянан удирдах байгууллагыг хэлэх бөгөөд ITTF-ийн Шударга байдлын зөвлөлийн гишүүдээс бүрдэнэ.
9.2.1.11“ITTF Integrity Board Members” means the individuals listed at R9.5.2 in these Regulations, who make up the composition of the ITTF Integrity Board.«ITTF-ийн Шударга байдлын зөвлөлийн гишүүд (ITTF Integrity Board Members)» гэж энэхүү Журмын R9.5.2-т жагсаасан, ITTF-ийн Шударга байдлын зөвлөлийн бүрэлдэхүүнийг бүрдүүлдэг хүмүүсийг хэлнэ.
9.2.1.12“ITTF Integrity Officer” means an employee(s) assigned to be part of the ITTF Integrity Unit, working under the instruction of the ITTF Head of Integrity, and any external specialist person or entity engaged by the ITTF Head of Integrity to perform a specific function for the ITTF Integrity Unit.«ITTF-ийн Шударга байдлын албаны ажилтан (ITTF Integrity Officer)» гэж ITTF-ийн Шударга байдлын албаны бүрэлдэхүүнд томилогдож, ITTF-ийн Шударга байдлын албаны дарга (Head of Integrity)-ын удирдамжаар ажилладаг ажилтан (ажилтнууд), мөн ITTF-ийн Шударга байдлын албаны тодорхой чиг үүргийг гүйцэтгүүлэхээр ITTF-ийн Шударга байдлын албаны даргын татан оролцуулсан аливаа гадны мэргэжилтэн хувь хүн эсвэл байгууллагыг хэлнэ.
9.2.1.13“ITTF Statutes” means the ITTF Statutes as published and amended from time to time.«ITTF-ийн Дүрэм журам (ITTF Statutes)» гэж үе үе нийтлэгдэж, нэмэлт өөрчлөлт орж буй ITTF-ийн Дүрэм журмыг хэлнэ.
9.2.1.14“ITTF Tribunal” means the highest judicial body within ITTF to hear and decide cases at first instance or as an appellate body as set out in the ITTF Tribunal Regulations.«ITTF-ийн Шүүх (ITTF Tribunal)» гэж ITTF-ийн Шүүхийн журамд заасны дагуу хэргийг анхан шатанд эсвэл давж заалдах шатны байгууллагын хувьд хэлэлцэн шийддэг, ITTF доторх хамгийн дээд шүүх эрх бүхий байгууллагыг хэлнэ.
9.2.1.15“Prima Facie Case’’ means any case of any breach of any Applicable Rule that the ITTF Head of Integrity considers sufficient to warrant investigation.«Анхны нотолгоотой хэрэг (Prima Facie Case)» гэж аливаа Хамаарах дүрмийг зөрчсөн, ITTF-ийн Шударга байдлын албаны дарга мөрдөн шалгахад хангалттай гэж үзсэн аливаа хэргийг хэлнэ.
9.2.1.16"Qualified Majority“ means two-thirds majority of persons taking part in the vote, not counting abstentions.«Шаардлагатай олонх (Qualified Majority)» гэж санал хураалтад оролцсон хүмүүсийн гуравны хоёрын олонхыг хэлнэ; түдгэлзсэн саналыг тооцохгүй.
9.2.1.17“Referral” means a referral to an Appropriate Person to deal with a minor violation of any Applicable Rule, as further described in R9.24.1.«Шилжүүлэлт (Referral)» гэж аливаа Хамаарах дүрмийн бага зэргийн зөрчлийг шийдвэрлүүлэхээр Зохих этгээд (Appropriate Person)-д шилжүүлэхийг хэлнэ. 9.2.1.18“Regulations” means these ITTF Integrity Regulations.«Журам (Regulations)» гэж энэхүү ITTF-ийн Шударга байдлын журмыг хэлнэ.
9.2.1.19“Report” means a report made regarding any alleged breach of any Applicable Rule, as further described in R9.15.1.«Мэдээлэл (Report)» гэж аливаа Хамаарах дүрмийг зөрчсөн гэж сэжиглэгдэж буй тохиолдлын талаар гаргасан мэдээллийг хэлнэ. Энэ талаар R9.15.1-д дэлгэрэнгүй тусгасан.
9.2.1.20“Simple Majority” means majority (more than 50%) of persons taking part in the vote, not counting abstentions.«Энгийн олонх (Simple Majority)» гэж санал хураалтад оролцсон хүмүүсийн олонхыг (50%-иас дээш) хэлнэ; түдгэлзсэн саналыг тооцохгүй.
9.2.1.21“Table Tennis Parties” means the parties listed at R9.4.1 in these Regulations.«Ширээний теннисний талууд (Table Tennis Parties)» гэж энэхүү Журмын R9.4.1-д жагсаасан талуудыг хэлнэ.
Where reference is made to any one of the parties mentioned in R9.4.1 below, the said party may be referred to as “Table Tennis Party”.Доорх R9.4.1-д дурдсан талуудын аль нэгийг дурдахдаа тухайн талыг «Ширээний теннисний тал (Table Tennis Party)» гэж нэрлэж болно.
9.3INTERPRETATIONТайлбарлах
9.3.1These Regulations are adopted pursuant to the ITTF Statutes and shall be interpreted in a manner that is consistent with applicable provisions of the ITTF Statutes.Энэхүү Журмыг ITTF-ийн Дүрэм журам (ITTF Statutes)-ын дагуу баталсан бөгөөд ITTF-ийн Дүрэм журмын холбогдох заалттай нийцүүлэн тайлбарлана.
In case of any conflict, the ITTF Constitution prevail over these Regulations.Аливаа зөрчилдөөн гарвал ITTF-ийн Үндсэн дүрэм (Constitution) энэхүү Журмаас давуу хүчинтэй байна.
9.3.2The headings and sub-headings in these Regulations are for convenience only and shall not be deemed to be part of the substance of these Regulations or to affect in any way the language of the provisions to which they refer.Энэхүү Журмын гарчиг, дэд гарчиг нь зөвхөн хэрэглэхэд хялбар болгох зорилготой бөгөөд Журмын агуулгын нэг хэсэг гэж үзэгдэхгүй, мөн холбогдох заалтуудын үг хэллэгт ямар ч байдлаар нөлөөлөхгүй.
9.3.3Words used regardless of the number and gender specifically used, shall be deemed and construed to include any other number, singular or plural, and any other gender, masculine, feminine or neuter, as the context requires.Тодорхой тоо (ганц, олон) болон хүйсээр хэрэглэсэн үгийг, агуулгаас шаардсанаар, бусад тоо (ганц эсвэл олон) болон бусад хүйс (эр, эм, эсвэл хүйсгүй)-ийг мөн хамаарна гэж үзэж, тайлбарлана.
9.3.4Any words following the terms “including”, “include”, “in particular”, “such as” or any similar expression shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase, or term preceding those terms.«үүнд», «багтаана», «ялангуяа», «тухайлбал» гэсэн эсвэл үүнтэй төстэй хэллэгийн дараа орсон үгсийг жишээ болгон дурдсан гэж ойлгох бөгөөд эдгээр хэллэгийн өмнөх үг, тодорхойлолт, хэллэг, нэр томьёоны утгыг хязгаарлахгүй.
9.3.5If any provision of these Regulations is held to be invalid, unenforceable or illegal for any reason, it shall be deemed to be deleted and the remainder of these Regulations shall otherwise remain in full force and effect.Хэрэв энэхүү Журмын аль нэг заалтыг ямар нэг шалтгаанаар хүчингүй, хэрэгжүүлэх боломжгүй эсвэл хууль бус гэж тогтоовол тухайн заалтыг хассан гэж үзэх бөгөөд Журмын бусад хэсэг бүрэн хүчинтэй хэвээр үлдэнэ.

9.4APPLICATION OF THESE REGULATIONSЭнэхүү Журмыг хэрэглэх хүрээ
9.4.1These Regulations shall apply to the following Table Tennis Parties (see ITTF Code of Ethics Preamble and Scope of Application):Энэхүү Журам нь дараах Ширээний теннисний талуудад (Table Tennis Parties) хамаарна (ITTF-ийн Ёс зүйн дүрмийн Оршил болон Хэрэглэх хүрээг үзнэ үү):

9.4.2The ITTF Integrity Unit shall have the duties, powers, and authority as set out in these Regulations to investigate and prosecute alleged violations of:ITTF-ийн Шударга байдлын алба (Integrity Unit) нь дараах зүйлсийн зөрчил гэж сэжиглэгдэж буй тохиолдлыг мөрдөн шалгаж, хэрэг үүсгэн хөөцөлдөх талаар энэхүү Журамд заасан үүрэг, бүрэн эрх, эрх мэдэлтэй байна:

Part II: Organisation of the ITTF Integrity UnitII хэсэг: ITTF-ийн Шударга байдлын албаны зохион байгуулалт
9.5THE ITTF INTEGRITY BOARDITTF-ийн Шударга байдлын зөвлөл
9.5.1The ITTF Integrity Board shall be the supervising body of the ITTF Integrity Unit and will be responsible for governing the ITTF Integrity Unit and ensuring that it carries out its roles and responsibilities in accordance with the ITTF Statutes and these Regulations.ITTF-ийн Шударга байдлын зөвлөл (Integrity Board) нь ITTF-ийн Шударга байдлын алба (Integrity Unit)-ыг хянан удирдах байгууллага байх бөгөөд уг албыг удирдах, мөн түүнийг ITTF-ийн Дүрэм журам болон энэхүү Журмын дагуу үүрэг, хариуцлагаа хэрэгжүүлж байгааг хангах үүрэгтэй.

9.6ITTF INTEGRITY BOARD CHAIR AND INDEPENDENT ITTF INTEGRITY BOARD MEMBERSITTF-ийн Шударга байдлын зөвлөлийн дарга ба ITTF-ийн Шударга байдлын зөвлөлийн хараат бус гишүүд

9.8.1The ITTF Integrity Board shall meet quarterly and each ITTF Integrity Board meeting shall be convened by the ITTF Integrity Board Chair.ITTF-ийн Шударга байдлын зөвлөл улирал бүр хуралдах бөгөөд ITTF-ийн Шударга байдлын зөвлөлийн хуралдаан бүрийг ITTF-ийн Шударга байдлын зөвлөлийн дарга (Integrity Board Chair) зарлан хуралдуулна.

9.9QUORUM AND MEETINGS OF THE ITTF INTEGRITY BOARDITTF-ийн Шударга байдлын зөвлөлийн ирц ба хуралдаан

9.16.5If the evidence submitted with, or subsequent to, any Report is considered by the ITTF Head of Integrity to establish a Prima Facie Case, the ITTF Head of Integrity will cause an investigation to be commenced, unless in their view and in consultation with the Integrity Unit Board, there is a good reason not to cause an investigation to be commenced either immediately or at all.Аливаа мэдээлэлтэй (Report) хамт эсвэл түүний дараа ирүүлсэн нотлох баримт нь прима фаси хэрэг (Prima Facie Case) тогтоож байна гэж ITTF-ийн Шударга байдлын албаны дарга (Head of Integrity) үзвэл, тэр мөрдөн шалгалт эхлүүлнэ. 9.16.7.2In the case of a termination of an investigation, ground will be provided, it shall be treated as a final decision and therefore may be appealed in accordance with the ITTF Regulations.Мөрдөн шалгалтыг дуусгавар болгосон тохиолдолд шалтгааныг нь заана. 9.17INVESTIGATIONSМөрдөн шалгалт

9.17.7.1.3The Alleged Person or Table Tennis Party will be entitled to have legal counsel and an interpreter present.Сэжигтэн (Alleged Person) эсвэл ширээний теннисний оролцогч тал (Table Tennis Party) хуульч болон орчуулагчийг байлцуулах эрхтэй.

9.17.7.2Provide (or procure to the best of their ability, the provision by a third party) for inspection, copying and/or downloading any records or files (whether existing in hard copy or electronic format) that the ITTF Head of Integrity reasonably believes may contain relevant information (such as itemised telephone billing statements, bank statements, ledgers, cryptocurrency wallets, transaction histories for any money transfer service or e-wallet, Internet service records, notes, files, correspondence, emails, and text of SMS, Whatsapp, Telegram, WeChat or similar messages received and sent);ITTF-ийн Шударга байдлын албаны даргын үзэж байгаагаар холбогдох мэдээлэл агуулсан байж болох аливаа бичиг баримт, файлыг (цаасан эсвэл цахим хэлбэрээр байгаа эсэхээс үл хамааран) шалгах, хуулбарлах болон/эсвэл татаж авахаар гаргаж өгөх (эсвэл гуравдагч этгээдээр гаргуулж өгөхийг чадах чинээгээрээ хангах). 9.18CONDUCT OF PROSECUTIONS BY THE ITTF INTEGRITY UNITITTF-ийн Шударга байдлын албаны явуулах яллах ажиллагаа

9.18.4The ITTF Integrity Unit will discharge its rights and responsibilities in good faith in all cases, taking into account both at the point of determining whether to issue a Notice of Charge and throughout any proceedings that follow:ITTF-ийн Шударга байдлын алба (Integrity Unit) бүх тохиолдолд өөрийн эрх, үүргээ чин шударгаар хэрэгжүүлнэ. 9.22.1.2Fails to respond by the deadline specified in the Notice of Charge (which will be deemed to amount to (a) a waiver of the Alleged Person’s right to have the charge(s) and/or sanction(s) determined by the ITTF Tribunal; (b) an admission of the charge(s); and (c) an acceptance of the sanction(s) specified in the Notice of Charge), the ITTF Integrity Unit will issue a public notice confirming the violation(s) committed and the sanction(s) imposed, and that notice will take effect as if it were a final decision of the ITTF Tribunal made in accordance with R9.29. 9.23HEARING BEFORE ITTF TRIBUNALITTF-ийн Шүүхийн өмнөх хэлэлцүүлэг

9.24.6The Appropriate Person may undertake such investigations in relation to the Referral and/or the Answer as the Appropriate Person deems necessary, including consulting with persons with knowledge of the facts and/or appointing experts to advise on specific issues.Зохих этгээд (Appropriate Person) Шилжүүлэг (Referral) болон/эсвэл Хариу тайлбартай (Answer) холбоотойгоор шаардлагатай гэж үзсэн мөрдөн шалгалтыг хийж болно. 9.24.7If upon investigation, the Appropriate Person identifies facts that suggest the sanctions set out in R9.24.10 may not be sufficient, given the conduct of the Alleged Person, the Appropriate Person may raise this with the ITTF Head of Integrity, who will then decide whether to maintain the Referral or else withdraw the Referral and pursue the matter in accordance with the ordinary procedures set out above.Хэрэв шалгалтын явцад Зохих этгээд (Appropriate Person) сэжигтний (Alleged Person) үйлдлийг харгалзан үзэхэд R9.24.10-т заасан шийтгэл хангалтгүй байж болохыг харуулсан баримт нөхцөл илрүүлбэл, энэ асуудлыг ITTF-ийн Шударга байдлын албаны даргад (Head of Integrity) тавьж болно. 9.25TRANSFER OF CASES FROM/TO ITTF MEMBERS, ETC.ITTF-ийн гишүүд болон бусдаас/руу хэрэг шилжүүлэх

Thereafter, the ITTF Integrity Unit shall not comment publicly on the specific facts of a pending case, except in response to public comments made by (or on behalf of) the Alleged Person or their representatives or where otherwise necessary to preserve the public’s confidence in the ability of the ITTF Integrity Unit to fight corruption in Table Tennis.Үүний дараа ITTF-ийн Шударга байдлын алба шийдвэрлэгдээгүй байгаа хэргийн тодорхой баримт нөхцөлийн талаар олон нийтэд тайлбар хийхгүй. 9.27.1The ITTF Integrity Unit shall take reasonable and proportionate measures at its discretion to protect any Table Tennis Party who has a honest and reasonable belief that there is a serious threat to their life or safety, or to the life or safety of another person.Өөрийн эсвэл өөр хүний амь нас, аюулгүй байдалд ноцтой заналхийлэл байна гэж чин сэтгэлээсээ, үндэслэлтэйгээр итгэж буй ширээний теннисний аливаа оролцогч талыг (Table Tennis Party) хамгаалахын тулд ITTF-ийн Шударга байдлын алба (Integrity Unit) өөрийн үзэмжээр боломжийн бөгөөд тохирсон хэмжээний арга хэмжээ авна.
9.28SANCTIONSШийтгэл
9.28.1Where the ITTF Tribunal decides that a violation of the Applicable Rules has been established, it may impose such sanction(s) as it deems appropriate in accordance with the Applicable Rules, in particular R8.35 of the ITTF Tribunal Regulations.ITTF-ийн Шүүх (ITTF Tribunal) хэрэглэгдэх дүрмийн (Applicable Rules) зөрчил тогтоогдсон гэж шийдвэрлэвэл, хэрэглэгдэх дүрмийн, ялангуяа ITTF-ийн Шүүхийн журмын (Tribunal Regulations) R8.35-ын дагуу зохистой гэж үзсэн шийтгэл(үүд)-ийг (sanction) ногдуулж болно.

9.29DECISIONSШийдвэр

9.30APPEALSДавж заалдах

9.32TIME LIMITSХугацаа
